Accounts
You are responsible for safeguarding the password and device that you use to access the Service and for any activities or actions under your password. Security of this device is the sole responsibility of the client. Incident Tracker is not responsible for any breach of the application including, but not limited to, lost or stolen phones.
You agree not to disclose your password to any third party. You must notify McKula Inc. immediately upon becoming aware of any breach of security or unauthorized use of your account.
Governing Law
These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between McKula Inc. and any customer subscribing to our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. All changes are effective immediately when posted, so we recommend that you check this page from time to time so that you are aware of any changes, as they are binding on you.

Data Protection
Data Processing and Access
Incident Tracker does not disclose, process, or analyse personal data for its own use or that of any third-party. Information stored within the application is never distributed outside of the application unless committed by a customer or user of the program.
Data Protection and Technology
Our internal processes include documentation of the location and security of any personal data. With this documentation, we can update and maintain data protection based on industry standards and practices.
Data Storage and Destruction
All databases, backups, and other files required for the use of the cloud application are maintained in Microsoft Azure.
By request of any customer, the data can be destroyed at any time. By policy, if a customer no longer subscribes to the Incident Tracker application, the full scope of data related to the customer is handed over, and with written authorization the data is destroyed.
Notification Process
Notification will occur within 24 hours of the initial incident via e-mail or telephone. Affected systems and information regarding what data was breached will be included with the notification. The Security Officer will be responsible for making the notification to the affected parties.
